As of March 1, 2021, for good and valuable consideration, the receipt and sufficiency of which is acknowledged, I (“the Writer”) hereby agree to and acknowledge the following:

1. These Terms and Conditions along with payment of the Fee state the entire understanding between Script & Story Inc. (“Script & Story”) and the Writer ("Writer", "I") with respect to my story. There is no other agreement, written or oral, express or implied, between Script & Story and me regarding the Submitted Document.
    

2. The “Fee” is the amount paid by the Writer to Script & Story paid via Script & Story’s website. Payment in full is required to receive script coverage, and is in U.S. dollars. The Student Price is available to Script & Story Students only. This means a Writer who is currently registered for a Script & Story course, or who has registered in the past. Any non-Student who submits for script coverage using the Student Price will have their transaction canceled and payment refunded in full, and will not be eligible for coverage until they resubmit their script and payment under the Regular Price. The Student Price for any given category or turnaround time will be rounded up or down at Script & Story's discretion.
    

3. I agree to submit my script to the proper category (Features, Shorts, or Episodic) based on the type of script I am submitting, and based on the number of pages my script is. If Script & Story receives a script that does not match the right category/price paid, Script & Story has the right to cancel the transaction and refund the amount paid in full.
    

4. I represent and warrant that I have the full and exclusive right to submit my project (the “Submitted Document”) to Script & Story for review.
    

5. I understand that Script & Story may have already and/or may in the future receive or independently develop materials similar to the Submitted Document. The Writer will have no legal recourse, financial or otherwise, for the aforementioned developed materials, past, present or future.
    

6. Script & Story will accept any obligation of confidentiality with respect to the Submitted Document and will provide confidentiality by this agreement. Script & Story has no right to copy, use, and/or distribute the Submitted Document for the purpose of distribution or publication of any kind.
    

7. Any feedback, comments and suggestions provided by Script & Story with regards to the Submitted Document become the sole property of the Writer. In the event the Writer receives monetary compensation or royalties for their Submitted Document, Script & Story will have no interest, gain or rights to that financial compensation.
    

8. Script & Story has the right to refuse to cover any scripts that contain disrespectful, derogatory or discriminating point of views against the LGBTQ+ community, people of colour, people with disabilities (physical, mental, etc.), women (including pregnant, impregnant or childfree), the elderly, or any group of enumerated people discriminated against.
    

9. I acknowledge and accept that there are no refunds for script coverage services provided pursuant to this Agreement.
    

10. I release Script & Story, its employees, agents, contractors, and anyone acting on its behalf, of and from any and all claims or causes of action of any kind, known or unknown, arising out of or relating to the Submitted Document. I agree that I will forgo making any claims or demands or bring any legal action against Script & Story in connection with the use or alleged use of the Submitted Document and expressly waive any and all such claims. I acknowledge that there may be facts relating or pertinent to the Terms and Conditions that I do not know or suspect to exist and I hereby waive my right to assert any claims arising from or relating to such facts.
     

11. In the event of any dispute concerning these Terms and Conditions, I hereby agree that I do not possess any remedy and will not seek actual damages and in no event will I be entitled to seek injunctive or other equitable relief. Any modification or waiver of the provisions of the Terms and Conditions must be signed by both a representative of Script & Story and me.
     

12. Script & Story is operated within the Province of Ontario, Canada. By accessing or using Script & Story, the Participant agrees that all matters relating to your access to, or use of Script & Story and its content shall be governed by the laws of the Province of Ontario, and the federal laws of Canada applicable therein, without regard to conflict of laws principles. The Participant agrees and hereby submits and attorns to the exclusive jurisdiction of the courts of the Province of Ontario, with respect to all matters relating to their access to and use of Script & Story and all the courses, intensives and services therein.
     

13. Any personal and/or contact information received will not be shared or sold by Script & Story.
